By creating a workspace, connecting a social media account, or using SocialSaaS, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Platform Description & Service Scope

SocialSaaS is a software-as-a-service application that allows organizations to schedule and publish social media content, manage private messaging conversations across channels, and configure comment-to-direct-message automations.

3. Compliance with Social Platform Terms

You agree to adhere to all terms, policies, and community guidelines established by the third-party platforms you connect to SocialSaaS, including but not limited to:

• Meta Platform Terms and Meta Developer Policies
• Instagram Terms of Use and Community Guidelines
• WhatsApp Business Platform Terms and Messaging Policies

Any violation of third-party platform policies that causes suspension or disruption of API access is solely the user's responsibility.

4. User Responsibilities & Prohibited Activities

When using SocialSaaS, you agree not to:

• Transmit spam, unsolicited commercial communications, or bulk unsolicited messages in violation of applicable laws.
• Distribute defamatory, abusive, harassing, fraudulent, or infringing content.
• Attempt to probe, scan, breach, or circumvent workspace security, tenant isolation barriers, or rate limiting mechanisms.
• Use the service to scrape, harvest, or extract unauthorized personal information from social networks.

5. Intellectual Property Rights

Your Content: You retain full ownership and intellectual property rights in the text, images, videos, and branding you submit or publish through SocialSaaS.

Platform IP: Advertely and its licensors retain all rights, title, and interest in SocialSaaS, including software code, interfaces, algorithms, and documentation.

6. Third-Party Services & API Availability

SocialSaaS depends on APIs provided by third-party platforms (such as Meta, Google, X, and others). Advertely is not responsible for platform outages, API deprecations, rate limits, or changes instituted by third-party social networks beyond our reasonable control.

7. Disclaimer of Warranties & Limitation of Liability

SocialSaaS is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. In no event shall Advertely be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.

8. Termination

You may terminate your account at any time by disconnecting your social connections and deleting your workspace. Advertely reserves the right to suspend or terminate access for violations of these Terms or third-party platform policies.
